The firm recognises that traditional court litigation, while sometimes necessary, is not always the most efficient or appropriate mechanism for resolving every dispute. ADR processes — particularly mediation and arbitration — frequently offer faster resolution, greater confidentiality, preservation of commercial relationships, and outcomes that better reflect the parties’ underlying interests.

Mediation

Both Mr. Charles Njuguna and Ms. Esther King’ori are certified and accredited professional Mediators through Strathmore University Dispute Resolution Centre, with accreditation since 2018. The firm offers mediation services both as a neutral mediator facilitating resolution between disputing parties and as legal counsel representing a party in mediation proceedings. The firm’s mediators bring expertise in commercial, construction, employment, land, and family disputes.

Arbitration

The firm provides comprehensive arbitration services, acting as counsel to parties in domestic and international arbitration proceedings. The firm has extensive experience with institutional arbitration rules, including those of the Nairobi Centre for International Arbitration (NCIA), the Chartered Institute of Arbitrators (Kenya Branch), and international institutions such as the ICC and LCIA. The firm also advises on the enforcement and setting aside of arbitral awards in Kenya under the Arbitration Act, 1995.

Negotiation

The firm regularly assists clients in negotiated settlement of disputes through structured negotiation processes. This may involve without-prejudice discussions, settlement conferences, or facilitated negotiation involving counsel on both sides.
